According to my neighbor;s attorney, he has six civil cases against him currently, plus a lien.
Tony, his sidekick has now stood her up twice when she has asked for a walk-through so that she can get her deposit back. The place is immaculate. She also found out from someone she works with that stayed there 4 years ago, that she never got her deposit back.
What's interesting is that she texted him and ask him where he was as she was waiting for him. He said to give the keys to the workmen. Interesting. Two minutes after she left, the workmen went in with instructions to work on the apartment. No walk through. Nobody checked.
Rick Hemerick had evicted 75% of his tenants when I arrived. Over the past month, in blatant violation of the lease, he evicted 25% - or rather attempted to! Every attorney consulted indicated that what Rick Hemerick and Tony were doing was completely illegal. Yet he has been getting away with it for years.
I cannot find a single thing about him on the web. So now I'm writing about it so that other people can be warned...

REPLY 28 Apr 2014 - No problem. Having helped my dad with his rentals I know the difference between inaction and a "Slumlord".
Had a neighbor that moved into one of his places on Greenfield in El Cajon. He charged her $500 deposit and after she moved in he charged her another $300 because she had a dog - which he knew about beforehand.
But I think they deserved each other because when she moved out after only 9 months of living there she had cracked and broken the tile in both the kitchen and bath, totally gouged and deep scratched the hardwood floors, and there was black mold everywhere. And the special she left was a backyard full of dog poo!
Yep, they deserved each other.

REPLY 28 Apr 2014 - I and at least three other people I know also had extremely negative encounters with Rick Hemerick (keeping deposits, renting units infested with cockroaches, blocking access to laundry, blocking handicapped access, entering units without proper notice). I hope more people read this and stay away. Congratulations on winning your case!
REPLY 6 Oct 2014 - +Claire Johnson For the record, Rick Hemerick owns 16 pages of apartments. The correct person to sue is The Hemerick Family Trust. I've met numerous people whom he doesn't refund deposits to. Apparently, this has been going on for 20 years or more.
In addition, he repeatedly breaks leases and evicts people as soon as they complain about bedbugs, roaches, etc.
He puts Rick Hemerick on the leases to mislead. It should be 'The Hemerick Family Trust.' He also never puts an address. His property managers possibly have false names and no addresses. We've checked their cell phone numbers and these are under the names of different people.
Hemerick also doesn't go to the small claims court to defend, That's because one is suing the name of the lease which is the wrong name. If you do this, there is a form to fill in SC-105 to change the name to Hemerick Family Trust.
After you have done that, claim three times the deposit that is not returned to you for deposit and damages.

Myself and some friends rented one of Rick Hemerick's apartments in San Diego (on 30th St) for the summer. We left at the end of august as we are students in Ireland but were on a summer visa. We are still awaiting our deposit ($1500). Starting to get suspicious, I started doing some research myself and found your review and some other reviews and saw all the court cases he's been involved in and realise now the slim chances of actually getting it back!! So I was wondering did you end up successfully getting your deposit back? And if there's anything else helpful you could tell me. I know it isn't a crazy amount of money but as 21 year old students I'm sure you can imagine it is quite a lot to us! To be honest though, its not even the money thing as much as the principle... I'm really angry that this guy (and Tony!!) is trying to take advantage of a young group of naive Irish girls. Feeling really stupid right now.

HaileyREPLY 15 Nov 2014 - PLEASE DO NOT SEND ME PRIVATE POSTS. If Rick Hemerick is not returning your deposit, it is the norm. This is what he does. The only way this man can be stopped is for the thousands of people to whom he did this is to post in public on the web. Post your story here and on yelp. He plays on the fact that the public does not know about this. When enough people have written about this, at some point, someone can begin to take a class action against the man and he will, hopefully, have to return every last penny to this hundreds of thousands of people he has retained deposits from over the past thirty years.

We found that we couldn't collect the money because he just put Rick Hemerick. I think you need to go to the court, explain the situation, and get some advice. He is being crooked as all hell by putting the wrong entity on the lease.

REPLY 11 Oct 2016 - My husband and myself are now currently dealing with rick and tony trying to charge us for an additional months rent on top of half a months rent even tho they told us our lease was 6 months then month to month afterwards. We only have a copy of a rental application that doesn't even specify a specific lease. I don't recall even signing a lease...not sure what to do but I know they are not readily available via phone or text message. Any thoughts? And I'm sure our deposit won't be returned even though the place was left immaculate. So glad to not have to deal with them as landlords anymore but this is still a pain in the as. #rickhemerick
REPLY 21 Apr 2017 - +Kat Brackett These people have cheated and stolen from tenants for more than two decades, and then get away with it. Basically, you need to go to court. Just ignore them. Don't pay. And get out as fast as you can.

- I am currently being evicted by Tony, assumedly because I told him I have cockroaches. He asked me on Monday if I sent my rent via mail or dropped it off and once I told him I dropped it off he immediately said he was issuing me a notice. He is such a terrible human being and has screamed at me numerous times in the few months I have lived there. Is there anything we can do together to stop this or receive justice??

We need publicity and we need some sort of collective legal action. However, none of us can afford that individually.

- Hi I have had some terrible issues with this person and property as well. I am so worried because my "deposit" which he now called "accounting" statement will be in the mail by Monday is worrying me. I've been looking him up and I really hope he isn't going to try to pull something shady over me. is it worth filing a claim if he does?

I was very clear that this is a violation of all of our rights, as he he illegally deducting my money from things are Landlord responsibilities. and that this a social justice matter.

- I will help how ever needed. I was told to also file a charge on him. but have you ever seen how many Charges he already has? ALOT! I think I have Tony's last name on the old "lease" I signed. I think getting the media involved would be the best action to take.
